Terms of Service

These terms apply between Eksire AS, org. no. 821 482 372 ("Mynto"), and the company registered in the service ("the customer"). You accept the terms expressly when you sign in, and in doing so confirm that you have authority to bind the company. Processing of personal data on the customer's behalf is additionally governed by the data processing agreement, which is accepted separately for each company.

1. Contracting party and authority

Mynto is a service for businesses. The agreement is entered into between Mynto and the company, not with you as an individual, and consumer protection legislation (including withdrawal rights) does not apply. The person registering the company confirms having the authority to bind it. Your identity is verified with BankID, and your role in the company is checked against public registers and Altinn authorisations.

2. The service and use of artificial intelligence

Mynto is accounting software that automates bookkeeping, invoicing, payroll and VAT. Mynto is software — not an authorised accountant under the Norwegian Accountants Act, and does not provide accounting, audit, tax or legal advice. The service uses artificial intelligence to suggest postings, interpret documents and prepare draft filings. Such suggestions may contain errors. Nothing is booked or filed with public authorities without your approval, and you remain responsible for reviewing and approving your accounts and all filings. The customer must use the service in accordance with applicable law and must not attempt to circumvent technical safeguards or use the service to keep inaccurate accounts. Mynto personnel may access your accounts when necessary to respond to a support request from you or to fix errors in the service that may have affected you. Such access is subject to confidentiality and limited to what is necessary.

3. Subscription and payment

Mynto Pro is billed monthly in advance. Prices are stated exclusive of VAT and may be changed with one month's notice, effective from the next billing period. You may cancel at any time, effective from the next billing period; prepaid fees are not refunded. Cancellation is done in the service, under settings — this ensures you can export your complete accounting archive before access ends.

4. Breach and suspension

In the event of non-payment or material breach of these terms, Mynto may suspend access to the service after reasonable notice. During suspension you retain read access and the ability to export your accounting archive — accounting data is never withheld as leverage. If the breach is not remedied within 60 days, Mynto may terminate the agreement; the export and deletion periods in section 6 then run from the date of termination. On justified suspicion that the service is being used for fraud or other unlawful activity — for example sending fictitious invoices or payments without a genuine basis — Mynto may nevertheless suspend access immediately and without prior notice.

5. Liability

Mynto is provided "as is", and we do not warrant that the service is error-free or available at all times. You are responsible for the accuracy of the information you provide and for approving everything that is booked and filed. Mynto is not liable for indirect losses, including loss of profit, loss of data or third-party claims. Mynto's aggregate liability is limited to the amount the customer has paid for the service during the twelve months preceding the event giving rise to liability. These limitations do not apply in cases of intent or gross negligence.

6. Retention of accounting records

As the party subject to Norwegian bookkeeping obligations, you are responsible for retaining accounting records under the Bookkeeping Act. Accounting records must be retained for five years after the end of the financial year (Bookkeeping Act § 13), and booked information must remain electronically available for three years and six months after the end of the financial year (§ 13b). While your subscription is active, Mynto fulfils this for you: booked entries and issued invoices are locked against deletion and modification, and your accounts remain electronically available in the service. You can export a complete archive (a SAF-T file per financial year plus all vouchers) from settings at any time. When your subscription ends, we retain your accounting data for 90 days so you can export the archive; after that it is permanently deleted. Your retention obligation continues after the customer relationship ends — you must export the archive and arrange continued retention yourself before this period expires.

7. Third-party services

The service depends on third parties such as your bank (PSD2 connection), Altinn, the Tax Administration, email providers and payment services. Mynto does not guarantee the availability of third-party services and is not liable for their errors or downtime. Altinn authorisations are granted by you, and you are responsible for their correctness. When you enable filing to public authorities, Mynto acts as an end-user system on the company's behalf towards Altinn and public agencies (e.g. the Norwegian Tax Administration). Filings and other actions Mynto performs after your approval are the company's responsibility as if the company had performed them itself, and use must comply with Altinn's terms at any time. The authorisation is granted and managed by you — typically by approving a system user in Altinn — and can be revoked there at any time.

8. Your data and intellectual property

The customer owns all accounting data, documents and other content entered into the service. Mynto owns the software, trademarks and all technology that forms part of the service. Mynto may use anonymised and aggregated data, which cannot be linked to the customer or any individual, to improve the service. Mynto may disclose information about the customer and the accounts to public authorities where Mynto is legally required to do so, for example under an order from the Norwegian Tax Administration or the courts — where the law so requires, also without notifying the customer.

9. Data Processing Agreement

Where Mynto processes personal data on behalf of the customer — for example about employees, customers and suppliers — the customer is the data controller and Mynto the data processor. The Data Processing Agreement forms an integral part of these terms and is entered into automatically upon registration. It is available at mynto.no/dpa.

10. Changes

Mynto may change these terms and the service. Material changes are notified at least 30 days before they take effect, in the service or by email. Continued use after a change has taken effect constitutes acceptance. If you do not accept the change, you may cancel with effect from the date the change takes effect.

11. Governing law and venue

These terms are governed by Norwegian law. Disputes shall first be sought resolved amicably; otherwise Oslo District Court is the agreed venue.
